Warranty Policy

R.F. Bakery Equipment Ltd. – Warranty

R.F. Bakery Equipment Ltd. (“RF Bakery”) warrants that all parts and equipment (“Products”) and labour (“Labour”) will be free from material defects in materials and workmanship, in accordance with the terms and conditions set out herein (the “Warranty”).

1. The term (the “Term”) of this Warranty is:

   1. for new Products that are not electrical parts, one year from the date of delivery;

   2. for new Products that are electrical parts, six months from the date of delivery;

   3. for used Products that are not electrical parts, three months from the date of delivery;

   4. for used Products that are electrical parts, 90 days from the date of delivery; and

   5. for Labour, 90 days from the date the Labour was completed.

2. If you find that any Product or Labour you purchased from RF Bakery has a material defect in materials and workmanship, you may notify RF Bakery (a “Warranty Notification”).

3. After submitting a Warranty Notification, if requested by RF Bakery, you must ship the defective Product (or component thereof) to RF Bakery at 73B Clipper Street, Coquitlam, BC, V3X 6X2. and at your cost. If the Warranty Notification is found to constitute a valid claim under this Warranty, RF Bakery will refund you the cost of ground shipping, regardless of the actual mode of shipping used (air, rush, etc.).

4. Following receipt of a Warranty Notification within the applicable Term, RF Bakery will determine if the Product or Labour has a material defect in materials or workmanship. If there is such a material defect, then RF Bakery will either repair or replace the Product (or a component thereof), redo the defective Labour, or provide a credit to your account for the amount paid for of the defective Product (or component thereof) or Labour. Refunds will be issued in appropriate circumstances at the sole discretion of RF Bakery.

5. Any labour provided under this Warranty will be performed within regular business hours. If you request that such labour be performed outside of regular business hours, you will be charged for the additional expense.

6. If RF Bakery receives a Warranty Notification after the applicable Term has expired, RF Bakery will have no obligation to repair, replace, or redo the defective Product or Labour.

7. This Warranty does not apply to:

   1. Products which have been subject to abuse or neglect, improper adjustments, repairs, modifications, alterations, or tampering, including installation of non-OEM parts;

   2. damage to Products caused by improper maintenance, lack of required maintenance, or the use of fluids, fuel, oil, or lubricants other than those recommend in the applicable owner’s manual;

   3. the cost of labour required to make normal adjustments to Products, including tightening of drive belts, drive chains, or conveyor belts, levelling of oven shelves, and recalibrating thermostats or thermometers, unless such adjustments are found to be necessary within 30 days of the date the Products were delivered; and

   4. products that have a normal life span shorter than the applicable warranty period, including light bulbs, filters, and blades.

8. Unless authorized in advance, RF Bakery will not pay for replacement Products purchased from third parties or labour provided by third parties.

9. This Warranty is transferable during the Term.

10. All disputes regarding this Warranty shall be governed by the laws of British Columbia and the laws of Canada applicable therein. All such disputes shall be resolved by the courts of British Columbia.

11. You agree to irrevocably and unconditionally attorn to the jurisdiction of the courts of British Columbia to determine all issues, whether at law or in equity, arising from this Warranty.
